Dion M. Bregman is a partner in Morgan Lewis's Intellectual Property Practice and serves as the hiring partner for the firm's Palo Alto office. Mr. Bregman has close to 20 years of patent law experience, focusing on both patent litigation and counseling (prosecution and licensing), and has represented public and private companies in a wide range of industries, including software and hardware, Internet and media, optoelectronics, cable and satellite television, telecommunications, medical devices, aerospace, audio technologies, and business methods. In 2012, Mr. Bregman was named a "California Lawyer of the Year" for Intellectual Property by California Lawyer.
Mr. Bregman has authored and prosecuted thousands of patent applications as well as dozens of patent reexaminations and reissue applications. He oversees large domestic and foreign patent portfolios for both Fortune 500 companies and startups. Mr. Bregman also regularly prepares exculpatory opinions of counsel.
One of Mr. Bregman's more recent victories was in the ActiveVideo v. Verizon case in the Eastern District of Virginia, where ActiveVideo obtained one the largest patent jury verdicts in the district this century. The total recovery, including post-trial rulings, will exceed $260 million. The district court also entered a permanent injunction against Verizon and ordered the company to pay a sunset royalty of more than double the royalty rate found by the jury for a 10-month month period while Verizon attempts to design around the patents in suit. In addition to the damages and injunction, two Verizon counterclaim patents were invalidated.
Prior to joining Morgan Lewis in 2004, Mr. Bregman practiced at a prestigious New York City-based intellectual property law firm. Before that, he practiced at one of the largest and most respected intellectual property firms in South Africa.
Mr. Bregman is admitted to practice in California and before the U.S. Court of Appeals for the Federal Circuit, the U.S. District Courts for the Northern and Central Districts of California, the U.S. District Court for the Eastern District of Virginia, and the U.S. Patent and Trademark Office.
