Partner Jonathan Lotsoff is quoted in Law360 discussing the recently passed deadline for employers in Illinois to apply for an equal pay registration certificate. Jonathan said while there seems to be some discretion as to how the Illinois Department of Labor penalizes companies that violate the new requirements, it may not look kindly on companies that do not comply for an extended period.
“We’d like to think that every covered employer did so. If they didn’t, you know, it’s probably prudent for them to get their application on file as soon as they can,” Jonathan said. “And one of the concerns would be if you first file a year or two from now, or you never file and the department finds out that you did business and were covered [under the law] . . . they may be more upset at that point and less likely to moderate or entirely mitigate a penalty.”
