Of counsel Kim Morning spoke with Law360 to discuss a forthcoming Supreme Court decision on the legality of the Universal Service Fund, a system managed by the Federal Communications Commission (FCC) used to pay for more than $9 billion in broadband and phone service subsidies.
During the case’s oral arguments, which took place in March, a majority of the justices made note of the potential consequences for the universal service program if they found its structure to be unconstitutional.
“Sometimes the court chooses not to have an extensive conversation about the consequences of their decisions,” but here, the Court appeared to take note of the roughly two dozen amicus briefs filed in the case, Kim said.
