Randall Mark Levine
Randall (“Randy”) Levine is the deputy practice leader for the products, torts, and environmental practice area. He represents clients in the energy, telecommunications, health sciences, and pharmaceutical industries in state and federal courts of appeals, complex multidistrict litigation, and class action litigation. He represents clients in multiparty, multiclaim litigation following environmental and other legal crisis scenarios, and has been involved in formulating broad-based litigation and global settlement strategies in some of the country’s largest and most complex civil proceedings.
Randy is an adept appellate advocate with particular experience navigating appeals in New York’s Appellate Divisions, having briefed and argued many cases in the Appellate Division’s First, Second, and Third Departments and in the Court of Appeals.
In the environmental space, Randy represents clients in litigation and appeals arising from contribution actions, enforcement proceedings, citizen suits, mass and toxic tort litigation, and regulatory matters, including actions under the Comprehensive Environmental Response, Compensation, and Liability Act (Superfund), the Clean Water Act, and analogous state laws.
Randy has worked on several high-profile environmental crisis cases for clients in the energy industry. He represented a nonoperating investor in connection with the Deepwater Horizon oil spill multidistrict litigation and associated appeals to the US Court of Appeals for the Fifth Circuit and the US Supreme Court. Randy also represented the Southern California Gas Company in state and federal trial courts and courts of appeal and before the California Public Utilities Commission in connection with a major natural gas leak from an underground natural gas storage facility.
Randy is an active member of the firm’s crisis management practice, using his experience at every stage of complex multiparty cases arising from environmental and other crisis scenarios.
- Represented a nonoperating investor in the In re: Oil Spill by the Oil Rig Deepwater Horizon multidistrict litigation in the US Eastern District of Louisiana and in related appeals to the Fifth Circuit and US Supreme Court
- Represents a major investor-owned natural gas utility and its corporate parent in California state and federal trial and appellate courts and before the state public utility commission in mass tort litigation arising from a gas leak from an underground natural gas storage facility
- Represented an aerospace technology company in a successful appeal to the US Court of Appeals for the Ninth Circuit in a CERCLA contribution action for costs to clean up a WWII-era production facility
- Represented and negotiated favorable settlements for a major pharmaceutical manufacturer in complex multidistrict mass tort litigation alleging public nuisance arising from prescription opioid abuse
- Represented New York public school districts in connection with federal district court class action litigations and on appeal to the US Court of Appeals for the Second Circuit
- Represented a defense contractor in an appeal involving breach of contract in the US Court of Appeals for the Third Circuit
- Represented a national bakery company in an appeal involving a worker classification dispute in the US Court of Appeals for the Ninth Circuit
- Represented a national bakery company in an appeal involving breach of contract in the US Court of Appeals for the Fourth Circuit
- Represented a national bakery company in an appeal involving a worker classification in the US Court of Appeals for the Second Circuit
- Represented a New York public school district in insurance coverage litigation in New York’s Appellate Division, Second Department
- Represented a technology company in an appeal involving breach of contract and alleged tortious interference with business relations in New York’s Appellate Division, First Department
- Represented a technology company in an appeal involving an indemnity agreement in New York’s Appellate Division, First Department
- Represented a technology company in an appeal involving restrictive covenants in New York’s Appellate Division, First Department
- Represented a New York public school district in an appeal involving administrative law and procedure issues in New York’s Appellate Division, Third Department and the Court of Appeals
