Partner Christoph Mikyska spoke to Markt und Mittelstand to discuss the General Court of the European Union’s decision in a recent trademark dispute related to registering “I” and red heart symbols as a motif.
“The decision of the General Court is logical because the design in question has been used generically for many years in different applications for a large number of products, especially in the souvenir sector, without consumers associating it with a reference to a specific origin of the goods from a particular manufacturer,” said Christoph.
