Morgan Lewis | The EU Pay Transparency Directive: What Employers Need to Know
The EU Pay Transparency Directive will create a wide range of new pay transparency obligations for employers that, when implemented by member states, will apply across the EU with the aim of reducing the gender pay gap.
These obligations will include requirements for employers to disclose pay data in response to requests from workers, comply with regular gender pay reporting obligations, take steps
to remedy identified pay gaps, and pay compensation where equal pay rights or obligations have been breached.
The Directive applies to all types of employers and there will be potential consequences for non-compliance, including fines. Employers will also need to navigate existing national pay transparency regimes alongside the additional requirements to which they will be subject under the Directive, including, for UK employers with operations in the EU, compliance
with the Directive in respect of
those operations.
