Gina F. McGuire defends companies involved in a broad array of complex and high-stakes employment disputes. Gina regularly handles discrimination, harassment, retaliation, wrongful termination, whistleblower, and compensation claims as well as ERISA class actions and benefits-related matters. Gina’s employment practice includes defense of individual and systemic class claims. Her ERISA practices includes individual claims and complex class action matters against employers and fiduciaries involving a wide range of claims under ERISA and involving defined contribution and defined benefit, severance, top hat, and health and benefits plans.
Gina litigates individual and class action matters before US federal and state courts, administrative agencies (including the EEOC, US Department of Labor (OSHA and EBSA), and the New York State Division of Human Rights), as well as arbitrations before the Financial Industry Regulatory Authority (FINRA), JAMS, and the American Arbitration Association (AAA). Gina’s practice also includes employment counseling, and she conducts and assists employers with workplace investigations on a variety of sensitive matters.
Pro bono work is also an integral part of Gina’s practice. In addition to counseling non-profit clients on employment law issues, she represents disabled veterans before the US Department of Veterans Affairs, while also providing counsel to asylum claimants.
