Matthew M. Papkin
Matthew M. Papkin represents clients in complex civil litigation, class actions, and mass arbitrations through trial and appeal. He defends manufacturers, retailers, financial services companies, and healthcare companies, among others, in consumer class actions involving claims of false marketing, fraud, breach of warranty, and product defects in state and federal courts across the United States.
Matt focuses his practice on high-stakes consumer disputes and has delivered decisive victories in pre-trial practice and at trial, including a recent class action trial in federal court that resulted in a jury verdict in favor of an automobile manufacturer. Matt also advises clients threatened with mass arbitration and defends clients in mass arbitrations through hearings on the merits.
Matt is a member of Morgan Lewis's Class Action Working Group and Mass Arbitration Working Group.
Prior to joining Morgan Lewis, Matt started his legal career at the Miami-Dade County Attorney’s Office, where he defended the county in civil actions through trial. From 2018 to 2019, he served as a law clerk to Judge Beth Bloom of the US District Court for the Southern District of Florida.
- Member of trial team that obtained defense verdict on behalf of an automotive company in class action involving claims of deceptive practices for allegedly concealing a vehicle defect
- Representing automobile manufacturer in mass arbitration involving vehicle defect claims
- Secured dismissal of a Racketeer Influenced and Corrupt Organizations (RICO) class action against a financial services company based on an alleged Ponzi scheme perpetrated by a former employee
- Obtained summary judgment on behalf of financial services company in a case involving an alleged Ponzi scheme perpetrated by a former employee and successfully defended the decision on appeal before the US Court of Appeals for the Ninth Circuit
- Defeated certification of a proposed nationwide class involving more than 7 million vehicles with allegedly defective heating, ventilation, and air conditioning systems
- Obtained summary judgment in a putative class action on behalf of online travel agency involving allegations of a deceptive website
- Obtained dismissal with prejudice of a putative class action against a major retailer alleging that its branded dietary supplement label failed to disclose the presence of certain ingredients
- Obtained the first dismissal with prejudice of a claim brought under the Helms-Burton Act and successfully defended the dismissal on appeal before the Eleventh Circuit
- Secured favorable individual settlement for apparel retailer in putative class action involving allegations of misleading labeling
- Obtained dismissal with prejudice of fraud claims on behalf of a US bank
- Successfully compelled arbitration in New York and Switzerland of Florida Franchise Act and contract claims brought by retailers against manufacturers
