Vincent C. Papa defends companies in high-stakes antitrust litigation nationwide. He represents clients in the life sciences, healthcare, insurance, and financial services sectors in federal and state law disputes. Vincent has managed antitrust matters from inception through trial and appeal, defending companies against allegations of price-fixing, monopolization, exclusive dealing, and tying. He also has an active counseling practice, advising businesses and trade associations on risk, compliance, and training. Before joining Morgan Lewis, Vincent clerked for Judge Peter Sheridan of the US District Court for the District of New Jersey.

  • Defending a brand pharmaceutical manufacturer against class action antitrust claims arising out of an alleged improper listing of certain patents for the diabetes drug Actos in the Orange Book
  • Defending a brand pharmaceutical manufacturer against class action antitrust claims arising out of an alleged horizontal conspiracy to delay and order market entry with respect to the gout drug Colcrys
  • Defending a leading healthcare provider against a putative class action alleging that the provider and its clinically integrated network of outpatient providers engaged in exclusive dealing, tying, and price-fixing in violation of Sherman Act Sections 1 and 2
  • Secured reversal of a $417 million judgment against a national insurer in a market allocation case
  • Defeated multiple attempts to certify a class of alleged direct purchasers in an alleged generic delay case
  • Defeated class certification motion and excluded class expert in price-fixing case against a prominent health system and its clinically integrated network of providers
  • Secured a successful resolution of a Section 1 claim against a brand pharmaceutical manufacturer after multiple trial days
