Petition Could Highlight Union Vote Bars for NLRB Action, Law360

He also observed that a recent US Court of Appeals for the Sixth Circuit decision could encourage the NLRB to rely more heavily on rulemaking when pursuing significant policy changes. “I think it’s a bit of a wake-up call for the board in that they may not be as able to do major policy promulgations through cases, and they may have to rely more on rulemaking,” John said. He added, "These are tough issues and which I would argue lend themselves to a rulemaking-type process."
