Ali Razai
Ali Razai is a first-chair litigator whose intellectual property (IP) practice focuses on high-stakes disputes involving a broad range of issues, including patents, trademarks, trade secrets, false advertising, unfair competition, and breach of contract. He represents biotechnology, medical device, pharmaceutical, green technology, consumer product, and mechanical device companies, among others, before federal district courts, federal appellate courts, the International Trade Commission, the Patent Trial and Appeal Board (PTAB), and arbitration panels. Ali’s background in molecular biology and prior experience as an antibody engineer strengthens his ability to address complex IP challenges.

Before joining Morgan Lewis, Ali was a partner at a national IP law firm where he served on the firm’s executive committee. Ali also previously seconded as an interim in-house patent counsel at a large multinational corporation.
- Lead trial counsel for a medical device company in a high-stakes patent litigation involving the first FDA-cleared at-home saliva collection device for COVID-19 PCR testing; obtained summary judgment of noninfringement on all patents-in-suit and invalidated the only nonexpired patent-in-suit before the PTAB
- Lead trial counsel for a medical device company in a high-stakes patent litigation and related inter partes review (IPR) proceedings related to solutions for nucleic acid preservation; successfully invalidated five patents, including an unprecedented finding that the patents were invalid for the patent owner’s misconduct before the PTAB during the IPR proceeding
- Lead trial counsel for global apparel company defending against allegations of trademark infringement related to a blockbuster product; obtained summary judgment of noninfringement at the district court and successfully defended the victory on appeal before the US Court of Appeals for the Ninth Circuit
- Lead counsel for a pharmaceutical company in a breach of contract arbitration involving the development of a heart rhythm drug; obtained favorable award after a three-day arbitration
- Lead trial counsel defending a chain of museums against claims of trademark infringement; obtained dismissal of claims at the district court and successfully defended the victory before the US Court of Appeals for the Ninth Circuit
- Lead trial counsel for a leading hot tub manufacturer alleging trade dress infringement against a look-alike product; obtained a favorable settlement, which included the defendant removing the accused product from the US market
- Lead counsel for a pharmaceutical company in a breach of contract arbitration against a global pharmaceutical company involving an Alzheimer’s drug; obtained favorable settlement
- Lead trial counsel in enforcement actions for large consumer products company; successfully represented or advised company in patent, trademark, and trade dress enforcement matters across the United States and in EU and Russia
- Obtained favorable claim rulings and consent judgment on patent validity and infringement for a pharmaceutical company in ANDA litigation
