Daniel C. Fishbein
Daniel C. Fishbein practices at the intersection of financial services enforcement and white collar defense. He specializes in representing both individuals and companies in civil and criminal matters initiated by the US Department of Justice (DOJ), the Consumer Financial Protection Bureau (CFPB), the Federal Deposit Insurance Corporation (FDIC), the Office of Comptroller Currency (OCC), the Financial Crimes Enforcement Network (FinCEN), the Federal Trade Commission (FTC), state attorneys general, and state banking departments. Daniel brings his vantage point and the breadth of his experience to representing financial institutions, nonbank lenders, fintech companies, and consumer service providers facing increased scrutiny from federal and state regulators.
Daniel represents clients in a range of industries and subjects involving bank regulatory, consumer protection, and white collar crime. He has defended clients in matters involving anti-money laundering and the Bank Secrecy Act, the Report of Foreign Bank and Financial Accounts (FBAR), residential mortgage-backed securities (RMBS), bank fraud, wire fraud, insider trading, the Foreign Corrupt Practices Act (FCPA), the Foreign Agents Registration Act (FARA), healthcare fraud, the Food, Drug and Cosmetic Act (FDCA), the False Claims Act (FCA), and the panoply of state and federal Unfair, Deceptive, or Abusive Acts or Practices (UDAAPs) laws and regulations.
Daniel’s pro bono practice focuses on representing indigent clients as appointed Criminal Justice Act (CJA) counsel, including representations in the US District Courts for the Southern District of New York and the District of Columbia.
