Daniel C. Fishbein practices at the intersection of financial services enforcement and white collar defense. He represents both individuals and companies in civil and criminal matters initiated by the US Department of Justice (DOJ), the Consumer Financial Protection Bureau (CFPB), the Federal Trade Commission (FTC), state attorneys general, state banking departments, and other government agencies. Daniel brings the breadth of his investigations experience to his matters and applies his vantage point to representing financial institutions, nonbank lenders, and fintech companies facing increased scrutiny from regulators.

Extended Profile

Daniel’s representations include clients in a range of industries and subjects involving bank fraud, the Report of Foreign Bank and Financial Accounts (FBAR), residential mortgage-backed securities (RMBS) fraud, insider trading, Unfair, Deceptive, or Abusive Acts or Practices (UDAAPs), the Foreign Corrupt Practices Act (FCPA), the Foreign Agents Registration Act (FARA), healthcare fraud, and the Food, Drug and Cosmetic Act (FDCA).

Daniel also has a meaningful pro bono practice. He represented a criminal defendant in the Southern District of New York and an advocacy organization as amicus curiae in a U visa nonimmigration status proceeding, and he achieved a favorable outcome for a victim in an excessive-use-of-force case.

During law school, Daniel participated in Northwestern’s Supreme Court Practicum, where he worked on Kingsley v. Hendrickson, 576 US 389 (2015), a landmark excessive use of force case involving pre-trial detention.
