Drew Cleary Jordan

Drew routinely works with clients on litigation avoidance and to develop and implement risk management strategies while also optimizing clients’ business needs. Drew has played a significant role in some of the most high-profile environmental litigation in the country, including the Aliso Canyon gas leak. He has experience with a broad range of federal and state environmental statutes, including the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA/Superfund), Resource Conservation and Recovery Act, and Toxic Substances Control Act (TSCA).

In addition to litigating matters in federal and state court and his regulatory counseling practice, Drew advises clients on settlement discussions, negotiating with government and regulatory agencies; contaminated site investigations; and formation of potentially responsible party groups in connection with contaminated sites. Drew handles matters involving groundwater and drinking water contamination, hazardous materials and wastes, property damage, contaminant migration, and historic war plants. He works closely with experts and consultants on complex environmental and regulatory issues in the areas of contaminated site remediation, vapor intrusion, groundwater modeling, and economic damages modeling.

Drew also represents clients in matters involving consumer class action and multidistrict litigation, fraud and RICO litigation, attorney general investigations and enforcement actions, consumer protection, business and corporate disputes, state and federal government investigations, and intellectual property. Drew also has experience with privacy, cybersecurity, and data security laws.

Drew previously served on the Princeton Pro Bono Committee and currently serves on the Washington, DC, Pro Bono Committee, including as vice chair from 2019 to 2022. He also served as the associate representative for the Princeton office. Drew frequently authors articles and speaks on issues involving emerging contaminants.

Prior to joining Morgan Lewis, Drew served as a law clerk to Judge Danny C. Reeves in the US District Court for the Eastern District of Kentucky. While attending Fordham University School of Law, Drew served as a notes and articles editor for the Fordham International Law Journal and was the recipient of the Archibald R. Murray Public Service Award. He also spent two summers interning for the National Labor Relations Board (NLRB).

• Represented energy infrastructure company and utility company in litigation and regulatory matters arising from a leak at a natural gas storage well
• Represented a consumer products company with respect to CERCLA liability at a Superfund site in Puerto Rico involving groundwater contamination
• Represented a real estate development and investment company in CERCLA cost recovery litigation against the United States for contamination stemming from WWII-era munitions production for the US military in Cranbury, NJ
• Represented a national energy provider in litigation involving claims under the Price Anderson Act for alleged property damage
• Represented an international chemical company in litigation involving claims under the New Jersey Consumer Fraud Act and in related litigation involving products liability and consumer fraud act claims, as well as other common law claims
• Represented a manufacturer of specialty chemicals in connection with a Superfund/Formerly Utilized Sites Remedial Action Program (FUSRAP) site in New Jersey where thorium had been produced; represented the company in the Superfund cleanup of chemical contaminants and radiological materials and provided counsel on related regulatory matters
• Represented a consumer product company on remedial obligations related to multiple Superfund sites in New Jersey
• Represented a global chemical manufacturer in connection with the remediation of radiological materials being conducted under the FUSRAP, as well as in a parallel Superfund cleanup of chemical contaminants
• Represented international and national consumer electronic product manufacturers and obtained dismissal of a putative consumer class action concerning flat-screen televisions
• Represented a portfolio of continuing care retirement communities in a putative class action under the New Jersey Consumer Fraud Act and other statutory and common law claims in New Jersey state court
• Defended a consumer-facing company in Telephone Consumer Protection Act litigation
• Defended national retailers in price comparison class actions
• Represented major mortgage loan servicing firm in foreclosure-related litigation
• Obtained dismissal of claims brought against retailers under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act
