Stephanie R. Feingold
Stephanie R. Feingold represents clients in litigation and dispute resolution with a focus on environmental issues, and provides environmental and regulatory counseling. Her work spans investigations, cost recovery and contribution actions, and enforcement actions brought by and against environmental agencies and government authorities, as well as private party actions, under both federal and state environmental laws. She defends major corporations and businesses in toxic tort actions, commercial litigation, and product liability litigation. Stephanie also counsels clients in matters involving drinking water contamination and emerging contaminants, including per- and polyfluoroalkyl substances (PFAS) and 1,4-dioxane. Stephanie also works with potentially responsible parties (PRPs) in connection with contaminated sites, including working closely with consultants and experts, and negotiating with regulatory agencies.
With experience serving as coordinating counsel in multiparty litigations, Stephanie has managed common interest relationships and negotiated and litigated joint defense agreements. She also counsels clients through every phase of complex litigation, including document retention, discovery and ediscovery compliance, and privilege issues. Her clients include companies in the energy, pharmaceutical, chemical, electronics, telecommunications, automotive, mining, real estate, and manufacturing industries.
In addition to her litigation work, Stephanie is a certified Leadership in Energy and Environmental Design (LEED) Green Associate. Stephanie also handles environmental matters surrounding transactions, including coordinating with environmental consultants and government authorities. Stephanie also counsels clients with regard to compliance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Toxic Substances Control Act (TSCA), and the FDA Green Guides in connection with the import, marketing and sale of various products in the US. Additionally, she advises on compliance with state single-use plastics bans, recycled content requirements, and bans on PFAS in consumer products.
Litigation
- Represents international electronics manufacturer in groundwater contamination cost-recovery litigation and administrative proceedings in Nassau County, New York, involving 1,4-dioxane.
- Represented a real estate development and investment company in Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) cost-recovery litigation against the United States for contamination stemming from WWII-era munitions production for the US military in Cranbury, NJ.
- Represented an automobile manufacturer in two related CERCLA and New Jersey Spill Act cost recovery and contribution actions in the District of New Jersey for costs associated with multisite removal and remediation of contaminated concrete, as well as other statutory, contractual and common law damages.
- Represents telecommunications company in multiple litigations in Nassau County, New York, alleging contamination to groundwater and soils from radionuclides stemming from work performed by predecessor companies on behalf of the United States, as well as alleged contamination from emerging contaminants and VOCs (including 1,4-dioxane).
- Represented national water purveyor in putative class action in the Southern District of New York alleging violations of New York General Business Law § 349, breach of contract, unjust enrichment, negligence, and fraud.
- Represents national chemical manufacturing company against cost recovery claims under CERCLA and the Minnesota Environmental Response and Liability Act stemming from WWII-era production on behalf of the United States.
- Defended a chemical manufacturing company in a cost recovery/natural resource damages suit brought by the New Jersey Department of Environmental Protection (NJDEP) in New Jersey state court.
- Represented national energy provider and mining company in litigation involving claims under the Price Anderson Act for alleged property damage.
- Defended municipal and private clients in litigation in the Southern District of New York involving toxic tort and personal injury claims related to debris removal and clean-up activities that occurred after the 9/11 terrorist attacks.
- Represented an international chemical company in litigation involving claims under the New Jersey Consumer Fraud Act, as well as in related litigation involving products liability and consumer fraud act claims, as well as other common law claims.
- Represented a power plant portfolio company in NY Supreme Court (Commercial Division) with regard to an indemnity claim under a purchase and sale agreement for seven power plants for breach of representations and warranties on operation and maintenance practices by the seller.
- Defended a pharmaceutical company in 100+ state and federal MDL cases alleging products liability, breach of warranty, and other related claims.
- Represents portfolio of continuing care retirement communities in class action under New Jersey Consumer Fraud Act and other statutory and common law claims in New Jersey state court.
- Represented property owner in litigation stemming from breach of lease by client’s tenant involving historic riverboat.
- Represented an electronics manufacturer in a claim for cost recovery under Indiana’s Environmental Legal Action Statue stemming from historical manufacturing operations.
- Represents former chrome plating manufacturing client in defense of environmental cost recovery and NRD action brought in late 2018 by the New Jersey Department of Environmental Protection (NJDEP) as part of the larger “environmental justice” initiative by New Jersey Governor Phil Murphy and New Jersey Attorney General Gurbir Grewal. The matter involves alleged chromium contamination at the Puchack Well Field Superfund Site in Pennsauken, NJ.
- Represents manufacturing clients in defense of a natural resources damages (NRD) lawsuit brought by the New Jersey Department of Environmental Protection (NJDEP), stemming from alleged discharge of hazardous substances, including trichloroethylene (TCE) and perchloroethylene (PCE), at a three-acre tool and dye manufacturing facility in Montvale, NJ, that purportedly migrated into groundwater beneath the facility and contaminated municipal drinking wells.
Enforcement and Administrative Proceedings
- Represents semiconductor manufacturing company in connection with MassDEP-directed investigation of potential per- and polyfluoroalkyl substances (PFAS) contamination at former Massachusetts manufacturing site.
- Advising a major international manufacturing company in evaluating operations at multiple US facilities for use of PFAS in products and supply chain.
- Represents mining and energy companies in connection with the investigation and remediation of a multi-party Superfund site involving low-level radioactive materials originating from Manhattan Project operations, including negotiations with the United States Environmental Protection Agency (EPA) and the US Department of Justice. Also represents the same companies in connection with a related multi-party cost-recovery claim by the United States for cleanup performed under the Formerly Utilized Sites Remedial Action Program (FUSRAP) at a nearby storage property, also involving low-level radioactive materials originating from Manhattan Project operations.
- Represents a global chemical manufacturer in connection with the remediation of radiological materials being conducted under the Formerly Utilized Sites Remedial Action Program (FUSRAP), as well as in a parallel Superfund cleanup of chemical contaminants.
- Represented an automobile manufacturer in civil and criminal proceedings associated with the decommissioning and demolition of an automotive assembly plant in New Jersey, where the State alleged the company violated numerous provisions of the New Jersey Solid Waste Management Act and New Jersey Spill Act at multiple sites. Negotiated an administrative consent order with NJDEP, settling the company’s liability to the State.
- Represented a major manufacturing company in connection with its entry into an administrative consent order with NJDEP to address an urban waterway contaminated with trichloroethylene (TCE), as well as Spill Fund and natural resource damages claims.
- Represented a global chemical company in municipal hearings concerning a manufacturing plant in New Jersey, where a municipality was seeking to designate the plant as part of an area in need of redevelopment.
- Represented a national retail energy provider in enforcement proceedings and litigation against various state public utility commissions.
- Represented an international chemical company in response to investigations by the Occupational Safety and Health Administration (OSHA) and the Chemical Safety & Hazard Investigation Board (CSB).
