Many employers are implementing or considering global or local restructuring exercises and redundancies as they navigate economic uncertainty, higher costs, inflationary pressures, and volatile supply chain networks.

Employers taking or contemplating such measures must ensure they understand and follow the applicable legal frameworks—or consider the legal and reputational risks for not doing so.

The legal framework that applies—and the specific obligations provided for under the applicable framework—will vary depending on the restructuring or redundancy plan itself and the country it is implemented in. The legal requirements can be challenging as the wider business context can impose stringent time pressures on any decisions and procedures being considered and executed.
