Post-Grant Challenges and Litigations
In this section, we break down post-grant challenges and Biologics Price Competition and Innovation Act (BPCIA) litigations, including the types of claims being challenged, the number filed each year, and their outcome. Notably, the current institution rate for inter partes review (IPR) challenges to patents that claim biologics—excluding IPRs that have settled or otherwise been terminated—stands at 57%.

FDA—Biosimilar Approvals
This section tracks all US biosimilar approvals. The number of approved US biosimilars is 89, with the most recent approvals being Zimrixby™ (rituximab-cdxx), Garzulys® (insulin aspart-fsan), Ranluspec® (ranibizumab-hkdz), Immgolis™ and Immgolis Intri™ (golimumab-sldi), Ennumo™ (pegfilgrastim-pccg), Langlara™ (insulin glargine-aldy), and Ponlimsi™ (denosumab-adet).

Legislative and Regulatory Updates
In this section, we highlight the Medication Affordability and Patent Integrity Act and the Biosimilar Red Tape Elimination Act, two bipartisan bills advanced to the full Senate by the US Senate Committee on Health, Education, Labor and Pensions (HELP). On the regulatory front, FDA published draft guidance titled “Biosimilar and Interchangeable Biosimilar Products: Considerations for Container Closure Systems and Device Constituent Parts.”
