Mark A. Fiore
Mark Fiore has a diverse civil litigation practice, with a focus on business and consumer disputes, mass torts, class actions, and crisis management. As a trial lawyer, he has experience with some of the largest and most complex civil cases in recent US history. He is well versed in a broad array of issues facing clients in the manufacturing, pharmaceutical, financial services, and healthcare industries, including fraud, false claims, public nuisance, products liability, consumer protection, unfair competition, tax, contract, insurance, and environmental-based claims.
Most recently, Mark served as litigation and trial counsel representing publicly traded pharmaceutical manufacturers in several high-profile trials brought by state attorneys general seeking billions of dollars in damages and abatement for public nuisance and consumer protection claims in connection with the nationwide opioid litigation. Mark was one of three trial lawyers leading the defense in a seven-month jury trial in New York state court, followed immediately by a two-month bench trial in West Virginia state court.
Mark was also a member of the trial team in a bench trial in Orange County, California, in which the team achieved the only complete defense verdict in the nationwide opioid litigation. In addition, Mark also served as lead litigation counsel for defense of claims for the Track 1 trial in the federal opioid multidistrict litigation (MDL) in the US District Court for the Northern District of Ohio and for claims brought in Oklahoma state court. Both of those cases were settled on the eve of multimonth trials.
Mark previously clerked with the Grand Jury and Major Crimes units of the Pennsylvania Office of Attorney General. His pro bono practice focuses on assisting United States military veterans through the Military Assistance Project and representing indigent criminal defendants in state court proceedings.

- Represented an international e-commerce company in multiple Department of Labor investigations concerning alleged health and safety violations in distribution facilities throughout North America. Convinced government regulators that no charges were warranted and/or that citations should be vacated after issuance.
- Represented a real estate developer in a multimillion dollar CERCLA cost recovery action against the United States Department of Justice – Environment and Natural Resources Division.
- Defended an international food processing company in a federal class action alleging civil RICO violations.
- Represented a closely-held international produce distributor in a complex oppressed shareholder action resulting in the dismissal of multiple claims and the dissolution of the minority shareholder’s interest.
- Represented a regional health club chain in a class action brought under the NJ Consumer Fraud Act, Health Club Services Act, Consumer Contract Warranty and Notice Act and the Retail Installment Sales Act.
- Represented the Chapter 7 Trustee of a liquidating trust in the prosecution of over $11 million in clawback claims for preferences and fraudulent transfers.
- Represented an international staffing firm in the defense of federal employment discrimination claims resulting in a favorable settlement prior to trial.
- Represented a commercial developer in a federal mortgage and bank fraud investigation resulting in a corporate plea for nominal restitution and no individual charges.
