Levi McAllister, head of the firm’s Electric and Zero-Emissions Vehicles (ZEV) Working Group, Energy Decarbonization Working Group, and Energy Commodity Trading and Compliance Working Group, helps companies across industries navigate the evolving regulatory and investment environment for both conventional and emerging energy technologies. As more sectors look to creative solutions to achieve sustainability and meet decarbonization goals and mandates, Levi guides clients seeking to reduce their carbon footprints, take advantage of new and evolving energy storage and infrastructure assets, and commercially monetize energy commodities, carbon credits, renewable energy certificates (RECs), sustainable fuel, and EVs and EV infrastructure in US and global markets. He is a member of the National Native American Bar Association, the Carbon Offtake Drafting Committee of the Association of International Energy Negotiators, and a frequent public speaker on energy and decarbonization issues.

In the ZEV sector, Levi advises clients in the utility, technology, retail, education, and automotive and aviation industries on all issues relating to ZEV growth. Levi focuses on ZEV leasing, network charging infrastructure development, siting and operation, ZEV funding opportunities, ZEV infrastructure monetization strategies, and vehicle-to-grid issues. He leverages existing knowledge of the market and developments in the ZEV sector to best position clients to successfully develop and implement their ZEV commitments and goals. 

Levi’s work in this sector enables him to advise clients on eVTOL issues in the rapidly evolving advanced air mobility (AAM) sector, where he assists clients in navigating the infrastructure and commercialization issues associated with AAM charging and electricity procurement. His knowledge in the ZEV and AAM sectors grows out of the more traditional electric power sector, where he provides clients with guidance on market access in Federal Energy Regulatory Commission (FERC)-regulated wholesale energy and capacity markets, market design issues, and the creation and sale of electric generating assets.

In the sustainability and decarbonization sectors, Levi counsels clients in all industries across the globe on issues arising in the voluntary and compliance carbon markets. He advises clients across the carbon markets ecosystem, including carbon credit project development, participation in compliance and voluntary carbon markets, emissions trading systems, carbon border adjustment mechanisms, sovereign carbon market development, tokenization of carbon credits, registry-related issues, and carbon credit methodology verification. 

In addition, Levi counsels clients in the aviation industry on issues arising under the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA) and in the maritime industry on issues arising under the International Maritime Organization (IMO). He guides clients in the aviation and maritime industries on global compliance mandates concerning sustainable aviation fuel (SAF) and sustainable maritime fuel (SMF), investment in and the development of SAF and SMF production facilities, and the long-term sale and purchase of SAF and SMF. 

Finally, Levi advises clients on all issues relating to purchases and sales of physical and derivative energy products, including electricity, natural gas, RECs, renewable identification number, and carbon credits and carbon offset transactions. He is well versed in the regulatory landscape surrounding carbon trading and has experience developing and analyzing physical and derivative commodity trading strategies designed to respond to carbon pricing regulatory developments.

Levi’s carbon markets and environmental commodities work is informed by significant experience advising participants in regulated commodity markets subject to FERC and Commodity Futures Trading Commission (CFTC) investigations. He advises clients on lawful organized market trading matters and power, gas, and petrochemical commodity trading strategies. 

Levi has advocated on behalf of clients in dozens of matters before FERC in non-public and litigated proceedings alleging fraudulent or manipulative conduct in violation of the Federal Power Act and Natural Gas Act, and before the CFTC in non-public and litigated proceedings alleging fraudulent or manipulative futures and derivatives trading in violation of the Commodity Exchange Act. Levi draws on this experience to develop company compliance programs, pursue internal investigations, and develop energy compliance training programs.
