13. April 2026The International Association of Privacy Professionals (IAPP) quoted partner Hannah Levin from a recent panel discussion at the IAPP Global Summit 2026 on the rise of data privacy and cybersecurity litigation in the United States.
Hannah discussed how the litigation landscape has shifted significantly, with lawsuits often filed before companies can fully respond to incidents. She explained that traditional risk assessments based on the number of affected individuals are no longer sufficient, as public disclosure and regulatory notification now drive litigation exposure.
“I no longer do that analysis anymore because it has become more of a question of, is this going to be a public breach? Are we going to notify an attorney general? And if so, the likelihood of a class-action lawsuit is extremely high,” Hannah said.
