Daniel S. Savrin
Daniel S. Savrin is a nationally recognized litigator at the trial and appellate levels. He represents clients in high-stakes litigation with a focus on antitrust, consumer protection, and civil and criminal government investigation matters. Daniel’s capabilities are lauded in leading peer review guides. He is ranked as Band 1 for Antitrust by Chambers USA where he is described as “top-tier – a very practical and value-oriented expert within the antitrust space,” a “highly regarded practitioner noted for his abilities across civil and criminal antitrust investigations and enforcement proceedings,” and “an expert in consumer protection matters.”
Daniel’s practice focuses on representing primarily consumer facing companies. His clients include, among others, leaders in the automotive, retail, ecommerce, food and beverage, insurance, and healthcare sectors. He is a leader of the firm’s consumer protection defense practice and automotive and mobility industry teams, with a focus on emerging issues in the electric and autonomous vehicle space. Daniel edited "Consumer Protection Law Developments" (Second Edition, 2016), a leading treatise on consumer protection law published by the American Bar Association.
Daniel is often called upon to litigate and try (or resolve) matters that involve parallel proceedings brought by federal agencies, primarily the Federal Trade Commission and the Department of Justice, state Attorneys General and private parties, often in class action settings. He has been recognized as a leading litigator and counselor for his experience in handling and trying civil and criminal matters and for his practical and effective approaches to litigating and resolving disputes with government agencies and among private parties.
Before joining Morgan Lewis, Daniel was a partner in the antitrust and trade regulation practice at another international law firm.
Antitrust Matters
- Represented leading automakers in joint venture and collaboration structuring and review efforts, including ones related to vehicle electrification
- Represented leading international manufacturer in highly publicized Department of Justice civil investigation that resulted in the closure of the investigation with no action being taken.
- American Cricket Premier League, LLC v. USA Cricket et al — Secured dismissal on standing grounds of antitrust challenge to selection of US professional cricket league
- Defense of major retailer in state Attorney General antitrust investigation of business practices resulting in the closure of the investigation with no action being taken.
- Defense of corporations in antitrust grand jury investigations of international cartel activities and parallel state Attorney General and civil class action litigation
- In re New Motor Vehicles Canadian Export Litigation — Defended BMW of North America, LLC and BMW Canada, Inc. in MDL and related state litigation. After a series of dismissals on the merits in a number of state court proceedings and dismissals of BMW Canada on personal jurisdiction grounds, voluntary dismissals were secured of all remaining claims.
- Thereafter, engaged to defend Nissan North America, Inc., Nissan Canada, Inc. and Nissan Motor Co., Ltd. in the same litigation. Secured judgments in three state proceedings after which the claims in the remaining states were voluntarily dismissed.
- State of Connecticut v. Guy Carpenter & Co. LLC, et al — Defended reinsurance broker against a lawsuit by the Connecticut attorney general alleging that the reinsurance broker engaged in decades-long antitrust conspiracy involving the sale of reinsurance through reinsurance facilities and other reinsurance marketing practices. The case was settled.
Consumer Protection Matters
- Defended higher education corporation in FTC Bureau of Consumer Protection investigation of marketing and advertising practices.
- Defended major retailer in FTC Bureau of Consumer Protection privacy practices investigation. Investigation was closed with no action being taken.
- Defended major automotive company in FTC Bureau of Consumer Protection marketing practices investigations. Matter concluded with limited remedial measures.
- Defended major e-commerce company with respect to regulatory investigation of disclosures related to initial discounts. Matter resolved with limited remedial measures and small payment.
- Defense of false advertising or labeling claims involving, among others, food, beverage, vitamin, and dietary supplement products.
- Defense of retailers in pricing, promotion, and marketing practices in state investigations and class action matters.
- Defense of numerous corporations with respect to individual and multi-state Attorneys General investigations involving consumer protection, deceptive advertising, internet advertising practices, pricing and privacy matters.
White Collar/Government Enforcement Matters
- Defense of healthcare providers in qui tam/False Claims Act investigations and litigation. Resolved matters civilly or secured closure of investigations with no civil or criminal liability.
- Defended healthcare providers in drug diversion investigations and litigation.
- Represented finance and insurance companies (both B2B and B2C) in government investigations and related litigation matters.
- Represented regulated parties in licensure and regulatory board investigations.
- Defended corporation in grand jury investigation of false claims act violations related to “Big Dig” construction project. The investigation terminated with no charges being filed.
