Ehsun Forghany is a trial lawyer specializing in patent, copyright, trade dress, and related intellectual property (IP) disputes. A former prosecutor, Ehsun has successfully tried more than 20 cases to verdict and argued well over 50 case-dispositive motions in state and federal courts, including two high-profile murder trials. Since joining Morgan Lewis, Ehsun has helped clients secure multimillion-dollar verdicts at trial and defend them on appeal, including a $2.9 million design patent verdict, $28.5 million copyright verdict, and $268 million utility patent verdict. For retail and consumer goods companies, Ehsun also curates creative and comprehensive solutions that help clients obtain and enforce IP rights for their industrial designs.
A co-author of Morgan Lewis’s annual PTAB Digest, Ehsun has extensive knowledge on administrative proceedings before the US Patent and Trademark Office’s Patent Trial and Appellate Board (PTAB), particularly inter partes review (IPR) proceedings challenging the validity of patents asserted in parallel district court proceedings. Ehsun represents clients in high-stakes IP disputes before the US International Trade Commission, helping clients obtain (and defend against) exclusion orders barring the importation of products into the United States.
As a recognized authority in design patent litigation, Ehsun has served as a guest lecturer at UC Berkeley School of Law and regularly presents at local and national conferences, including for the San Francisco and Silicon Valley IP Lawyers Associations, PTAB Bar Association, and American Bar Association Intellectual Property Law Section.
Ehsun has been inducted into the Fellows of the American Bar Foundation, an honorary society with membership limited to 1% of the lawyers licensed to practice in a jurisdiction.
