Partner Sage Fattahian spoke with Fortune about ways in which employers can help employees amid a fluctuating landscape for in vitro fertilization laws. Sage, co-leader of the firm’s reproductive rights task force, was interviewed following the Alabama Supreme Court’s ruling that frozen embryos should be afforded the same legal protections as living children under a state wrongful death law and subsequent approval by the Alabama legislature of a measure to protect patients and medical workers.
“It is a lot for employers to have to deal with this type of legislation,” Sage said. “This all started with Dobbs, and increasingly, we’re starting to see greater access to care be restricted as it relates to reproductive care.”
