Morgan Lewis partner Dion Bregman comments on the US Patent and Trademark Office’s guidance stating that patent owners can file for a “sur-reply” without seeking the PTAB’s permission. Bregman notes, “If you read between the lines a little bit, what they’re saying is, ‘Don’t think that as a petitioner you can put in one strong ground and 10 weak ones and get institution on all of them.’”
