Morgan Lewis partner Anne Marie Estevez, co-chair of the firm’s retail and ecommerce industry group, was interviewed by Law.com about a spate of recent class actions alleging retailers violate the Americans with Disabilities Act (ADA) if their gift cards don’t include writing in Braille. While Title III of the ADA requires that public accommodations provide “appropriate auxiliary aids and services where necessary to ensure effective communication with individuals with disabilities,” the government makes no mention of gift cards. “They are trying to stretch the law to places no one reasonably contemplated could be covered,” Annie said in the article.
