Private Equity Deals Face More Antitrust Scrutiny Under Proposal, Bloomberg Law

Morgan Lewis partner  David Brenneman spoke with Bloomberg Law for an article about the rule proposed by the US Federal Trade Commission and the Justice Department’s Antitrust Division that will expand the meaning of “person” in terms of reporting transactions for antitrust review under the Hart-Scott-Rodino Act. Due to the manner in which companies have been structuring their acquisitions, the proposed  rule “would increase the burden for many private equity groups,” David said in the article.
