Parties Skipping Their Homework at the Copyright Claims Board, Managing Intellectual Property

Partner Meaghan Kent commented in an article for Managing IP on the number of cases dismissed by the Copyright Claims Board (CCB) since it opened its doors in June 2022. The piece notes that the CCB has dismissed 68.6% out of 102 now-closed cases on the basis that the claims didn’t comply with the requirements of the Copyright Alternative in Small-Claims Enforcement Act, and an additional 9.8% of cases because the claimant provided no proof or waiver of service. 

Meaghan noted that despite training provided by the US Copyright Office and the Copyright Alliance, having lawyers involved in the process to assist claimants would likely increase the number of compliant claims.
