Benjamin C. Davis
Benjamin Davis represents employers in high-stakes employment and commercial disputes in state and federal courts and before arbitral tribunals. Ben is known for combining rigorous legal analysis, strategic judgment, and practical business insight to deliver effective advocacy in both single‑plaintiff and complex employment matters. Ben regularly defends employers against claims arising under the Florida Civil Rights Act, Title VII of the Civil Rights Act, the Age Discrimination Act, the Fair Labor Standards Act (FSLA), and the Americans with Disabilities Act (ADA). He also advises employers on restrictive covenant disputes, internal and regulatory investigations, compliance issues, and proactive risk‑mitigation strategies.
In addition to his labor and employment practice, Ben has significant experience handling complex commercial litigation, including business torts, corporate fraud and misconduct, asset recovery, RICO claims, and disputes arising in insolvency and restructuring contexts. This broader litigation background allows him to approach employment disputes with a sophisticated understanding of business risk, leverage, and strategy.
After law school, Ben served as a judicial law clerk to the Honorable Beth Bloom of the US District Court for the Southern District of Florida and as a postgraduate fellow to the Honorable Robin S. Rosenbaum, now of the US Court of Appeals for the Eleventh Circuit. These roles provided him with a deep understanding of how courts evaluate arguments and evidence, a perspective he brings to bear in crafting effective litigation and arbitration strategies for his clients.
- Represented a national news organization in nationwide gender and age discrimination class action and wage and hour collective action, obtaining denial and dismissal of class allegations and victories on summary judgment and a complete defense verdict after a jury trial on the remaining claims
- Represented a local telecommunications company in various employment disputes brought pursuant to the ADA, Florida Civil Rights Act, Age Discrimination in Employment Act, and the FSLA
- Represented a national security and private defense provider in an employment dispute before the American Arbitration Association involving alleged violations of the FSLA and Florida Civil Rights Act
- Represented a food importer and exporter in a restrictive covenant dispute and counseled the company through the hiring of various employees, avoiding litigation entirely
- Represented and counseled a shipping and logistics company in connection with the hiring of employees, assisting with navigation through restrictive covenant-related issues to avoid litigation
- Represented a healthcare technology and data analytics company in a restrictive covenant dispute with a competitor concerning the hiring of a C-suite executive
- Represented a healthcare technology company in a regulatory investigation commenced by the US Federal Trade Commission
- Represented a non-US company in an International Centre for Dispute Resolution proceeding against shareholders of a South American target company that asserted contract and fraud claims, among others
- Represented US and non-US construction companies in an International Centre for Dispute Resolution proceeding against a joint venture partner involving contract claims and a plethora of issues concerning application and interpretation of UK, Italian, and Spanish law
- Represented the official liquidators of an international life and health insurance company in connection with a foreign insolvency proceeding under Chapter 15 of the Bankruptcy Code, bringing claims for civil RICO, wire fraud, and embezzlement and pursuing recovery of misappropriated insurance funds through multijurisdictional litigation and asset collection strategies
- Represented a private high-wealth individual asserting claims of fraud and securities violations, among others, against a private investment manager
- Represented a well-known television personality in a business dispute involving claims of breach of fiduciary duty and breach of contract, obtaining dismissal with prejudice in client's favor on the latter, and successful resolution of the former
