Coleen M. Meehan’s commercial and civil litigation work focuses on complex commercial and business tort matters. Litigating cases at the trial and appellate levels in US state and federal courts, she also appears before the American Arbitration Association, the Trademark Trial and Appeal Board of the US Patent and Trademark Office, and the National Advertising Division of the Council of Better Business Bureaus. Coleen also advises clients on intellectual property (IP) and electronic discovery matters.
Coleen represents clients across varied industries, including publishing, manufacturing, consumer products, insurance, pharmaceutical, healthcare, and financial institutions. She counsels clients on issues involving false advertising, trademarks, trade secrets, licensing, and unfair competition. Coleen also regularly advises clients and colleagues on matters relating to e-discovery, including the retention and discovery of information stored electronically.
Active in firm management, Coleen is the Administrative and Assigning Partner for the Philadelphia litigation practice and former chair of the Philadelphia office’s Professional Recruiting Committee. She also runs the Philadelphia office’s pro bono practice with the Montgomery County District Attorney’s office, in which attorneys from the firm represent the Commonwealth of Pennsylvania in prosecuting alleged criminals at hearings and trials.
Representing abused children and women, Coleen is a volunteer attorney for the Support Center for Child Advocates and Women Against Abuse. She is an adjunct professor of law at Villanova University School of Law, where she teaches civil pretrial practice. Coleen is active in the community and formerly served as a member of the Board of Directors of the United Way of Southeastern Pennsylvania and of Catholic Social Services.
Co-lead counsel to a licensee of an internationally known trademark in the prosecution of claims against the licensor for breach of the terms of the license agreement, breach of fiduciary duty, and breach of the covenant of good faith and fair dealing. Following the conclusion of the liability phase of the mandatory arbitration, which resulted in a multimillion-dollar award for Coleen’s client, Coleen negotiated a complex settlement for her client that included cash payments and favorable prospective licensing rights.
Lead counsel to the US subsidiary of an international bank in the prosecution of injunctive claims against a departing executive alleged to have stolen trade secrets, breached noncompete provisions, and breached confidentiality obligations. After successfully obtaining injunctive relief for her client, Coleen obtained a permanent injunction, which, among other things, precluded the defendant from working for a new employer and competing against her client.
Lead counsel to one of the largest insurance and financial services companies in the world in the prosecution of trademark infringement claims arising out of the defendants’ gray market sales of insurance policies purportedly issued by Coleen’s client. After successfully obtaining injunctive relief and a sanctions order for her client arising out of the defendants’ destruction of documents, Coleen obtained a permanent injunction.
Lead counsel to a healthcare insurer in the defense of a multimillion-dollar breach of contract action involving a dispute over reimbursement provisions of a multiyear contract. Coleen obtained a complete defense verdict for her client.
Lead counsel to a leading manufacturing company in the defense of a breach of contract and business fraud action involving a dispute over the termination of a distribution agreement. After obtaining summary judgment for her client on the contract claims, Coleen negotiated a favorable settlement for her client.
Lead counsel to a leading medical device manufacturer in the defense of a breach of contract and business fraud action involving a dispute over the termination of a distribution agreement. After successfully filing a Rule 12 motion challenging the court’s subject matter jurisdiction, Coleen negotiated a favorable settlement for her client.
Lead counsel to a healthcare insurer in the defense of a multimillion-dollar breach of contract action involving a dispute over application of Medicare’s recapture of depreciation. Coleen obtained a complete defense verdict for her client.
Lead counsel to an investment and information technology firm as plaintiff in the US District Court for the Eastern District of Pennsylvania in the prosecution of a breach of contract action against a national company. At trial she secured a verdict for the plaintiff with a damage award in excess of $1 million. On appeal to the Third Circuit, she secured an additional award for the plaintiff.
Lead counsel to a construction company in the Superior Court of the District of Columbia in the defense of a breach of contract action. At trial, the jury entered a defense verdict for Coleen’s client on all disputed claims.
Co-lead counsel to a healthcare insurer in the defense of a class action asserting, inter alia, antitrust claims arising out of the client’s use of a “most favored nations” provision. After successfully defeating the plaintiffs’ motion for class certification, she obtained successful settlement for her client that involved no payments or prospective changes to her client’s business strategy.
Co-lead counsel to a major healthcare insurance company in two nationwide class actions challenging the method of payment for out-of-network medical services. After she successfully represented company before a Special Master, a favorable global resolution was reached.
Lead counsel to one of the largest water utility companies in the Commonwealth of Pennsylvania in the defense of a putative class action seeking compensatory and punitive damages and statutory penalties challenging the company’s calculation of bills for water services and alleging breach of contract and violations of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. She successfully challenged the court’s subject matter jurisdiction to determine rates charged by public utilities, and the court sustained the challenge and transferred the matter to the Public Utility Commission.
Co-lead counsel to a global pharmaceutical company in the United States District Court for the Eastern District of Pennsylvania in the defense of a qui tam action alleging violations of the False Claims Act for alleged failure to pay proper rebates to Medicaid and other governmental healthcare programs for certain of its products and for allegedly engaging in certain improper sales and marketing activities. She negotiated a complex settlement with the federal government, the 49 states that participate in the Medicaid program, the District of Columbia, and realtor.
Lead counsel to one of the leading manufacturers of paint specialty and home maintenance products as plaintiff before the National Advertising Division of the Council of Better Business Bureaus in a false advertising action challenging the unsubstantiated claims of a national manufacturer of competing products. Coleen obtained a complete judgment for the plaintiff with directions that the defendant discontinue its advertising claims.
Represented one of the United States’ largest technology companies before the Federal Trade Commission in a case alleging violations of Section 5 of the FTC Act where challenged conduct included engaging in unfair methods of competition, acts, or practices to unlawfully maintain and create a monopoly, thereby stifling innovation and harming competition and consumers.
Lead counsel to a global pharmaceutical company in the Circuit Court of the Seventh Judicial District, Illinois, in the defense of an action alleging defamation and intentional infliction of emotional distress. Coleen obtained complete dismissal of the action on a motion to dismiss.
Lead counsel to a global leader in advanced registry services in an action in the Circuit Court of Loudoun County, Virginia, in the defense of an action alleging misappropriation of trade secrets. After engaging in aggressive discovery, Coleen negotiated a favorable settlement for her client.
