Michael James Ableson
Michael Ableson is a litigation lawyer who handles the full spectrum of commercial and business disputes, including mergers and acquisitions (M&A), business torts, and unfair and deceptive trade practices litigation. Michael advises clients across all industry sectors, with particular experience advising life sciences, financial services, and defense clients. Michael’s courtroom advocacy experience includes representations in myriad US state and federal courts. He has a strong secondary practice in False Claims Act litigation, successfully defending clients from state and federal qui tam lawsuits seeking billions in alleged damages.
Michael’s legal practice includes experience handling actions brought on an expedited basis where one or both parties was seeking injunctive relief to address time-sensitive issues. For example, Michael secured a temporary injunction (later converted into a permanent injunction and affirmed on appeal) on behalf of a defense contractor to prevent a former subcontractor from pursuing a competing bid for a major government procurement. Michael has also defended clients against actions seeking to enforce similar noncompetition obligations.
Michael’s multijurisdictional practice has included representing clients in matters before state and federal courts in California, Delaware, Florida, Maryland, Michigan, New York, New Jersey, Ohio, South Carolina, and South Dakota and appellate cases before the Second, Fourth, Sixth, Ninth, and Eleventh Circuit Courts of Appeals, as well as New York’s First Department.

- Summary judgment for financial services client in commercial dispute arising from alleged breach of contract concerning auction of financial instruments, followed by affirmation on appeal
- Judgment on the pleadings for pharmacy chain in False Claims Act action, accusing pharmacy of submitting false claims to Medicare and Medicaid
- Dismissal with prejudice of lawsuit against life sciences company in commercial dispute concerning allegedly unpaid royalties for intellectually protected surgical technique
- Dismissal with prejudice of lawsuit against financial services client accused of submitting false corporate tax returns to New York State tax authority, followed by affirmation on appeal
- Dismissal with prejudice of False Claims Act action against financial services client accused of submitting false claims in connection with loan servicing, followed by affirmation on appeal
