Michelle Pector concentrates her practice on domestic and global complex commercial litigation and arbitration, consumer class actions, misappropriation of trade secrets, unfair competition, employment disputes, and personal injury. A substantial part of her practice is devoted to defending energy, healthcare, and technology clients in a broad range of business and employment disputes. Michelle works with clients to develop practical, innovative, and effective solutions tailored to achieve their business and legal objectives.
Michelle also provides counsel focused on her clients’ interests and long-term strategic goals. She offers advice on best practices, internal investigations, compliance matters, contract negotiations, and legal strategy pre-litigation, as well as post-litigation consulting to implement learned solutions. Michelle appears in mediations, injunction hearings, arbitrations, and trials.
Acted as arbitration counsel in a complex contract dispute between a leading oil field services provider and a wireless broadband company involving more than $100 million in claims. After more than two weeks of testimony, a unanimous defense verdict was awarded to the client.
Represented a major energy company in the successful defense of a multimillion dollar consumer fraud class action in California, which resulted in a favorable settlement for the client.
Worked as trial counsel for a medical device manufacturer when a competing company misappropriated confidential information acquired in negotiations. After completing discovery on an expedited basis, obtained injunctive relief in federal court enjoining the retention and use of confidential information and securing royalty payments for the client. After a successful two day injunction hearing, the case was resolved with a highly favorable settlement for the client.
Acted as lead litigation counsel in various Telephone Consumer Protection Act class actions filed throughout the country, resulting in the dismissal of claims and/or favorable settlements for the clients.
Defended a global oilfield services company in a significant off-depth perforation dispute, resulting in a favorable resolution for the client.
Acted as lead trial counsel for a healthcare company in an employee raiding matter. After conducting effective expedited discovery, the client obtained extensive injunctive relief, thereby safeguarding its trade secrets and business.
Successfully represented a leading oil field services company in a contentious dispute involving theft of trade secrets and enforcement of nonsolicitation agreements, resulting in extensive injunctive relief and a highly favorable settlement for the client.
Served as lead counsel in various lawsuits involving claims of discrimination or retaliation where summary judgment was obtained in favor of clients.
