Understanding the New HITECH Act Proposed Rule

On July 14, the Department of Health and Human Services published a notice of proposed rulemaking that introduces important new changes to the HIPAA privacy, security, and enforcement regulations, implementing the provisions of the Health Information Technology for Clinical Health Act (the HITECH Act).

The rule will apply to all HIPAA-covered entities, including new requirements in the areas of marketing, fundraising, sale of health information, research authorizations, and privacy notices.
