Morgan Lewis partner Georgia Bullitt will be speaking on a panel entitled "Who, What and Where?" - Product and Entity Definitions, at the 34th Annual Law & Compliance Division Conference on the Regulation of Futures, Derivatives and OTC Products.

The FIA Law & Compliance Division holds a spring conference on the East Coast each year. Compliance officers, attorneys, and regulators consider issues affecting the legal and regulatory framework of the derivatives industry.

Most of the key rulemaking under Title VII of the Dodd Frank Act are dependent on two sets of rulemakings: namely, what constitutes a "Swap" as well as other products, and who is a "Swap Dealer", a "Major Swap Participant", a "Security-based Swap Dealer", a "Major Security-based Swap Participant", and an "End-User" qualifying for exemptions under the mandatory clearing mandate. The panel will discuss these definitions and how they relate to registration requirements and certain duties. The panel will also discuss the role of the National Futures Association in managing the registration process. In addition, the panel will discuss issues relating to foreign exchange, the definition of eligible contract participants, and the implications of the extraterritorial application of the rules.
