2018 IP Academy Series: Updates of US Patent Practice – Recent Developments (presented in Japanese)

For the December webinar, we will review two pending cases before the US Supreme Court and discuss the following topics:

  • Whether an offer to sell occurs where the offer is actually made or where the offer contemplates that the proposed sale will take place. For example, do you infringe a US patent if you made an offer to sell in the United States but delivered the product elsewhere?
  • May a court construe a patent claim in a way that contradicts its plain and ordinary meaning by relying on statements in the specification that do not constitute lexicography or disavowal?
