Join our team of healthcare regulatory lawyers from Morgan Lewis to discuss recent case law developments that have a tremendous impact on how health systems interact with the Medicare program. Beginning with the Escobar decision from three years ago, which questions whether everything that is labeled a condition of payment truly qualifies as such, to the more recent Allina and Kisor decisions, which significantly pare back the agency's ability to act informally, these decisions all change the regulatory landscape in ways that are mostly favorable to healthcare providers. Yet, there are many unanswered questions, such as:

  • How do these cases impact a provider's 60-Day Repayment Rule analysis?
  • Which reimbursement issues are suddenly now susceptible to reimbursement challenges that couldn't be challenged before?
  • What issues still have to be fleshed out in future decisions?

We will summarize the recent cases, as well as their implications for providers, and then facilitate a roundtable discussion using a number of real-life hypotheticals to discuss best practices for addressing these matters in the shifting regulatory environment. We encourage participants to share their perspectives as well.
