12:00 PM - 01:00 PM Pacific Daylight Time

The extraordinary circumstances of the coronavirus (COVID-19) pandemic may provoke another crisis for the healthcare industry in the form of liability claims for noncompliance with COVID-19 protocols or other standards. Hospitals, nursing homes, physicians, and other front-line care providers fall within the ambit of the PREP Act’s immunity protection.

Our webinar will provide an update and analysis of the PREP Act focusing on the category of “covered persons” who “prescribe, administer, or dispense” the “countermeasures” that are protected by the act’s liability shield. We will also focus on other state and federal immunities that may impact potential COVID-19 liability.

Topics will include:

  • An overview of the PREP Act and its protections
  • A deeper analysis of the HHS Advisory Opinion and available guidance relating to the PREP Act in the context of the COVID-19 public emergency
  • State initiatives to provide immunity from liability to healthcare providers
  • Legal and practical risk management considerations for providers continuing to manage their operations in the crisis
