Employment Law in 2021: A Look Ahead

Employers can expect a number of changes in the employment law landscape under the Biden administration. Hear insights from former government officials on the anticipated priorities of the US Department of Labor (DOL) and Equal Employment Opportunity Commission (EEOC) under the new administration and the agencies’ new leadership.

We will discuss the administration’s executive orders so far, and look ahead to possible executive action, rulemaking, and legislative developments on top-of-mind employment issues, including:

  • Pay equity and pay data collection
  • Systemic racism and implicit bias
  • Federal paid leave mandate
  • Workplace safety during a pandemic and beyond
  • FLSA/wage and hour issues including independent contractor classification, joint employment, and $15 minimum wage
  • Federal contractor obligations, including OFCCP updates, minimum wages and paid leave, and bans on arbitration
  • Prevailing wage laws
