Federal Bar Association's 2023 Qui Tam Conference

Morgan Lewis partner Douglas Baruch will speak at the Federal Bar Association’s 2023 Qui Tam Conference.

Douglas will participate on the panel “Customs Fraud under the FCA: A Deep Dive.” The panel will cover tariff measures on goods imported from China and how an increasing use of trade remedies has added to the duties collected by the US Customs and Border Protection. The panel will meet on Thursday, February 16, from 2:45– 3:45 pm ET.

Along with those increases in collections comes an equal increase in fraud. From simple under valuation or incorrect tariff classification to more complex country of origin fraud, customs-related False Claims Act (FCA) cases are increasing in frequency and in value.

The panel will discuss the ways customs fraud cases arise, the aspects of information gathering and investigations involved in customs fraud, the special defenses that may be available, and the government agencies that may be involved throughout customs fraud FCA cases.

The panel will be moderated by Timothy J. McInnis, attorney at McInnis Law, and will also feature William Marshall, of counsel at Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt LLP.
