PWFA Regs Headline EEOC's Biggest Policy Moves From 2023, Law360

Partner Sharon Masling spoke with Law360 about major rulemaking and compliance guidance from the US Equal Employment Opportunity Commission (EEOC) over the last year, including the release of a fact sheet that outlines how civil rights laws apply to automated technology and a technical assistance document that addresses discrimination based on workers' visual or auditory disabilities, an issue that has increasingly become an area of focus for the EEOC.

Sharon said such guidance is of interest to those who want to understand the EEOC’s opinion on artificial intelligence. "Certainly, the agency has made clear that it is a priority, so any guidance that suggests how the agency is thinking about the issues [and] how they are going to approach the issues from an enforcement perspective is always really helpful," Sharon said.

Sharon also noted that “guidance documents like the commission's vision- and hearing-related releases, which are laid out as Q&As, are helpful both in substance and format ‘because they are user-friendly summaries of the EEOC interpretation of the [ADA] and how the law should be implemented in a variety of circumstances.’”
