BIS Suspends $1.7m Fine on California Semiconductor Tool Company, Global Investigations Review

The article outlines how BIS used a one-year suspended penalty to address unauthorized exports to China while requiring the company to implement compliance measures. Mike explained that although inability-to-pay considerations have long been part of BIS enforcement, the timeline presents practical challenges.

“The one-year suspension is not a lot of time for any company to implement an effective export controls compliance program,” Mike noted, adding that the reprieve may still provide an opportunity for the company to better understand regulatory expectations around risk and end-use provisions.
