The Fourth Circuit on Thursday affirmed a lower court’s decision to toss a suit alleging that Nestle USA Inc., Gerber Products Co. and The Dannon Co. Inc. failed to warn consumers that their baby food products contained too much fluoride, saying that federal law preempts the claims.
