M.D. Anderson’s $4.3 Million Fine for Patient Data Loss Vacated, Bloomberg Law

Bloomberg Law covered a Fifth Circuit ruling that dismissed a $4.3 million penalty against The University of Texas MD Anderson Cancer Center, secured by Morgan Lewis. On January 14, the US Court of Appeals for the Fifth Circuit vacated the penalty imposed by the US Department of Health and Human Services (HHS) against MD Anderson for a trio of data breaches. The court ruled that the “HHS acted arbitrarily and capriciously in finding that the provider violated two information security regulations.”
