Partner Elizabeth Goldberg spoke with Bloomberg Law about a proposed regulation from the US Department of Labor (DOL), which states that fiduciaries’ duty of prudence “may often require” consideration of the economic effects of climate change. “That to me is a significant departure maybe even from what the DOL has ever said, because it comes close to an endorsement of the view that ESG is a material factor that maybe even needs to be considered,” Liz said.
