Partner Kenneth Nunnenkamp’s comments regarding a new executive order tying the work of the Committee on Foreign Investment in the United States (CFIUS) more closely to national security priorities and adding new factors to consider during the committee’s review process were included in a roundup published by Foreign Investment Watch.
Reacting to the executive order, Kenneth recommended that parties to a transaction consider broad industry trends and transactions.
“It may now be prudent for parties investing in certain sectors to consider whether their transaction could run into trouble not on its particular facts,” he said. “[B]ut because the aggregate foreign investment in that sector is considered by CFIUS to be enough.”
