Partner Erin Martin, who previously worked in the US Securities and Exchange Commission’s (SEC’s) division of corporation finance, discussed potential legal challenges to the SEC’s proposed climate change rule in a Pensions & Investments article.
Republican lawmakers and some businesses have argued the SEC lacks authority to enact such a requirement. “[I]t's fair to say that it's way more likely than not that if it does go into effect substantially the same as it was proposed, it is going to be subject to significant legal challenge,” Erin said, given the pushback the proposal has received.
