Lawyers Say DOJ Policy Change Won’t Yield More Self-Disclosures, Global Investigations Review

Partner Amanda Robinson spoke to Global Investigations Review about changes to the US Department of Justice’s (DOJ’s) corporate enforcement policy, which includes incentives for companies to voluntarily disclose misconduct and fully cooperate with investigations. Amanda said companies will need to see proof of benefits—rather than just the promise of them—if the DOJ wants to see more voluntary disclosures.

“Clearly DOJ has been trying to get companies in the door and it hasn’t worked,” Amanda said.

“More is needed, including actual demonstration that the benefits of self-disclosure are there.”
