Partners Justin Weitz and Giovanna Cinelli are quoted in an Agenda article about efforts by the US Department of Justice (DOJ) to investigate corporate crimes that overlap with national security.
Justin noted that public companies should work with counsel to ensure they cooperate with DOJ where such cooperation is warranted, given the sensitivity of national security investigations.
“A public company that is viewed as unsupportive of a national security initiative certainly runs risk,” Justin stated.
Giovanna discussed the relationship between the US Committee on Foreign Investment in the United States (CFIUS) and DOJ, noting that the CFIUS process is not focused on criminal activity. DOJ, however, is a standing member of the committee represented by its national security division.
“That engagement can educate [DOJ] on matters that could raise corporate crime issues—such as with export controls, sanctions and government contracts,” Giovanna said.
