Monaco: DOJ Won’t Prosecute Companies for Misconduct Disclosed Shortly after Acquisitions, GIR

Global Investigations Review quoted partner Justin Weitz in an article about the US Department of Justice’s (DOJ’s) new policy—outlined by Deputy Attorney General Lisa Monaco—to not prosecute companies that disclose the misconduct of a recently acquired business. Justin said Monaco’s remarks formalize the department’s policy on the potential benefits of voluntary self-disclosing misconduct in the context of an acquisition.

“It’s consistent with the tone that DOJ has struck in the last few months – a softer tone to let companies and counsel know that if you self-disclose misconduct, remediate, and cooperate, DOJ will meet your good faith with their good faith,” Justin said.
