Partner Seth Gerber is quoted in a Managing IP article that provides insight into how some companies and legal counsel are reacting to the Federal Trade Commission’s latest rule to ban non-compete agreements. Seth said that no matter what happens, he believes the new rule will lead to greater legislative action from states that will shape business sustainability.
“We’ll continue to see a rollback on the use of overly broad restrictive covenants that hinder economic growth,” Seth said.
“Many companies have limited the scope of their confidentiality clauses to try to better capture what they truly consider to be propriety information.”
