Partner David Plotinsky was quoted in an MLex article discussing the US government’s review of Nippon Steel’s proposed acquisition of US Steel, highlighting the legal concerns and broader implications of increasing political influence over national security reviews.
“There’s no provision in the law for CFIUS to conduct another review after it refers a transaction to the President,” David said. “So, my view is that the new CFIUS review was conducted essentially in an advisory capacity to the White House, and not under the CFIUS statute or regulations.”
