Partner Heather Egan spoke with Lexology Pro for an article about recently proposed draft amendments to the Colorado Privacy Act from the state attorney general’s office, which would expand privacy rights to older teens and require companies to document potentially addictive online features.
Heather noted that if these amendments are adopted, companies may increasingly implement age-gating online tools to explicitly identify minors, requiring the collection of more personal information to confirm a user’s age, which could exacerbate the data privacy concerns the amendments are trying to address.
“It almost creates a requirement to learn more about the individual and [deploy] persistent tags for purposes of identifying a minor to ensure you are complying with this law,” Heather said.
